Privacy Policy Last updated: October 3, 2026 1. About this policy Apex Labs Pte. Ltd. (“Mercle”, “we”, “us” or “our”) operates the Mercle mobile app, website, APIs, identity verification, rewards and wallet-related services. This policy explains what personal information we collect, why we use it, who receives it, how we retain it and how you can exercise your choices. Face photographs, facial representations and related verification information can be sensitive personal or biometric information. The optional photo contribution campaign has its own consent, purposes and retention limits, explained below. Its 90-day photo retention limit does not apply to separate identity verification records. Mercle is not currently offered to residents of Africa or Europe, including the European Union, European Economic Area, United Kingdom and Switzerland. These availability restrictions do not remove any privacy rights that apply under law. 2. Information we collect Account and contact information We collect information you provide to create, authenticate, recover or manage an account, such as an email address, phone number, country code, account identifiers, profile information and an optional profile picture. If you use Apple, Google or another supported sign-in provider, we receive the identifiers and profile information that the provider makes available for your chosen sign-in. We also process verification codes, authentication results and support messages. Verification and face information When you start camera-based verification, liveness, account recovery or a repeat verification, the relevant flow can collect face images or video frames, liveness results, facial representations used for matching, comparison results, verification status, timestamps and security records. A face embedding is a numerical representation used to compare faces. Verification can involve comparing a face with an earlier reference or searching for a possible duplicate identity. Optional photo contributions If you separately agree to join a photo contribution campaign, we collect the front and side photographs you choose to submit, the original camera files, prepared review images, limited capture metadata and quality annotations. Section 4 describes these contributions in detail. Wallets, connected services and rewards We process public wallet addresses, blockchain networks, wallet-ownership verification signatures, transaction information, account-linked reward records and information needed to display balances or assets and carry out features you request. If you connect a supported social account or other service, we receive the account identifiers, verification results and information covered by the permissions you approve. Device, interaction and technical information We process device and operating system information, app version, language or locale, network information such as IP addresses, device or installation identifiers, notification delivery tokens, app interactions, crash reports and performance or security logs. Session replay and interaction analytics can help us understand navigation and diagnose usability problems. We mask photo contribution screens and pause replay during that flow. Your device also stores information needed to operate the app, including authentication tokens, preferences and session information. Unsubmitted photo contribution drafts are encrypted on the device and expire after 24 hours. We do not purchase personal information from data brokers to build user profiles. The photo contribution flow does not request gallery access, GPS location, audio, video, depth captures or ProRAW. Permissions required by other app features are described when those features request them. 3. How we use information We use information to: - Create and authenticate accounts; verify contact details; support account recovery and user requests. - Check liveness and identity continuity, detect duplicate identities and reduce bots, spoofing, fraud and account abuse. - Provide rewards, connected-account features, wallet functionality and transactions you request. - Operate, secure and improve the app and its infrastructure, investigate errors and understand how features are used. - Send verification codes, service messages and notifications, subject to your applicable settings. - Develop, test and evaluate models and quality checks where that use is covered by the notice and consent applying to the data. Optional campaign contributions are governed by Section 4. - Maintain necessary consent, security, reward, dispute and compliance records and meet applicable legal obligations. We do not sell personal information, supply face information to data brokers or use face or wallet information for third-party advertising. We do not use personal information for advertising that tracks you across other companies’ apps or websites. 4. Optional photo contribution campaigns Participation and consent Photo contributions are optional. Before enrollment, the app explains the proposed collection, purposes, processing services, storage location, retention and reward terms. You must explicitly agree, confirm you are at least 18 and contribute only photographs of yourself. Camera permission alone is not agreement to join this campaign. Accepted consent is remembered for the relevant campaign scope. A materially different processing scope requires a new description and explicit consent before that use. A later policy update, a reward or participation in identity verification does not automatically expand the consent applying to earlier contributions. Collection and purpose The campaign uses contributed face photographs to develop and evaluate Mercle models for distinguishing different people and recognising a returning participant. Contributing photographs or receiving a reward does not verify your identity. We retain the original HEIC/HEIF or JPEG camera file and prepare a separate full-resolution, upright JPEG for review and dataset preparation. Original files preserve their camera information; embedded metadata is removed from the prepared JPEG. We record limited information separately, including capture time, device and operating system, image dimensions, exposure and ISO, file checksums, preprocessing versions and quality annotations. We do not request location for this campaign. Processing and access On-device checks assist with framing and possible image-quality concerns. Amazon Web Services S3 stores campaign images privately in US East (N. Virginia), United States. AWS Rekognition DetectFaces processes submitted JPEGs for advisory face geometry, landmarks, pose, sharpness, brightness and occlusion information. Authorised Mercle reviewers inspect submissions. Provisional quality checks are not proof of identity or a guarantee of photograph quality. This collection pipeline does not currently retain face embeddings or use a face-search collection. A future use that adds retained embeddings requires a separately described scope and renewed consent before that use. The separate identity verification service described in Section 5 can use face embeddings and face-search matching. Retention, stopping and deletion Campaign originals and prepared JPEGs are retained for up to 90 days. Temporary uploads expire after one day. Unfinished encrypted drafts on your device expire after 24 hours. Rejected or fraud-flagged contributions are excluded from identity-model training; retaining material in restricted quarantine does not authorise another use. You can stop contributing or request deletion in My photo contributions. Stopping blocks future campaign collection and authorised use. Deletion requests target live photo copies within seven days and backup or processor copies within 30 days. Completion depends on operational verification; the app can show a deletion receipt and distinguish outstanding backup verification. Account deletion also initiates withdrawal and deletion of campaign contributions. Essential consent, reward and deletion records are maintained separately from the photographs. Deleting a photograph or withdrawing cannot automatically remove its influence from a model that has already been trained. A retained record or an earned reward does not authorise future training use of withdrawn contributions. 5. Separate identity verification and liveness Verification uses camera captures and related results to establish that a live person is present, compare with an earlier identity, detect duplicates, prevent fraud and support account recovery or repeat verification. AWS Rekognition can perform liveness and face matching, and AWS S3 can store reference images. Mercle’s identity systems also process associated matching and security records. Information may be used for internal testing, quality improvement and model development only within the purposes, notice and permissions applying to that collection. The optional campaign’s agreement is separate from verification. Verification reference images, face-matching representations and associated identity records are retained for ongoing matching, identity continuity and duplicate-registration or abuse prevention. Their retention depends on those purposes rather than the campaign's 90-day photo limit. Some of these records are preserved after deletion of an app account. Deleting your app account therefore does not automatically erase all verification face information. You can request deletion of verification face information by contacting us. We review requests under applicable law and explain any information that must be retained, the reason and the applicable retention criteria. Continued retention for security or another purpose must have a valid basis; this policy does not authorise unrestricted reuse. Campaign photo deletion and its stated timeframes remain separate from this verification process. 6. Service providers and other recipients We use providers to operate the service. Depending on the feature, these include: - Amazon Web Services for hosting, storage, liveness, face matching, photo-quality analysis and messaging infrastructure. - Google Firebase for crash reporting and supported notification services. - Microsoft Clarity for interaction analytics and session replay, with masking and pausing in the photo contribution flow. - Email, SMS and WhatsApp delivery providers, including Resend and Twilio, for authentication and service communications. - Privy for supported embedded-wallet and wallet-authentication functionality. - Apple, Google, connected-account providers, wallet services and blockchain infrastructure when you use their integrations. Providers receive information needed for their role, such as contact details for message delivery, technical data for diagnostics or images for the face-processing operations described above. We require providers acting on our behalf to protect the information they receive through appropriate confidentiality, security and purpose restrictions consistent with this policy and applicable law. Providers you choose to use independently, including wallet apps, sign-in services and public blockchain networks, also operate under their own privacy terms. Authorised Mercle personnel may access information for review, support, security and operations. A connected application can receive verification results, account or service identifiers and information covered by the permissions you approve for that integration. We may disclose information when legally required or necessary to address a security incident, enforce our terms or protect users’ rights and safety. Information may also be transferred during a merger, acquisition or other business transfer, subject to applicable privacy obligations. 7. Wallets and public blockchains Connecting a wallet lets Mercle process its public address, network and signatures or transaction requests that you authorise. Supported embedded wallets use a wallet provider to manage wallet functionality and cryptographic operations. Do not provide a seed phrase or private key to Mercle support. Public addresses and blockchain transactions can be visible to anyone and may be permanent. Deleting a Mercle account or disconnecting a wallet cannot erase public blockchain history. Manage wallet permissions and transaction approvals through the relevant wallet or provider. 8. Retention of other information Account, profile, connected-service and wallet records are kept to operate your account and the features you use. When you request account deletion, the deletion process removes account records and initiates applicable linked-data cleanup. Any remaining record must be limited to an applicable legal, security, fraud-prevention, accounting or dispute purpose. The verification face-data exception is expressly described in Section 5; campaign photos follow Section 4. Support correspondence, technical logs and security or consent records are retained according to the need to resolve requests, operate the service, investigate incidents, document permissions and meet applicable obligations. Their retention depends on the record’s purpose and any applicable legal requirement. We do not promise a single fixed period for every record category. Backup and provider copies can require additional time to be removed. Public blockchain records are controlled by the relevant network. Information that has been irreversibly anonymised and can no longer reasonably identify a person may be retained for aggregate analysis; a face photograph, face embedding or hashed identifier is not treated as anonymous merely because a name was removed. 9. Your choices and requests You can: - Decline optional photo contributions, stop participation or request campaign-photo deletion in My photo contributions. - Revoke camera and notification permissions in your device settings. Revoking camera permission stops future access; it does not delete previously submitted information. - Request deletion of your Mercle account through the in-app account settings or by emailing us with the subject “Delete my Mercle account”. - Request access, correction, deletion or other available rights by contacting us. For verification face information, identify that you want deletion of verification face data as well as any account deletion. - Disconnect supported wallets or linked services through the available account or provider controls. We may request information needed to verify ownership before acting. Applicable law determines your rights, any permitted exceptions and response requirements. We explain when a request cannot be completed in full. Availability restrictions do not waive those rights. You may also contact the relevant privacy authority where that right applies. 10. Security and international processing We use safeguards such as encrypted network connections, encrypted local photo drafts, restricted storage, access controls and limited permissions to protect personal information. Access to sensitive face information is restricted to the personnel and systems needed for the described processing. No system is completely immune from security incidents. Where required, we notify affected users and authorities about a breach. Mercle and its providers may process information in countries outside your own. Campaign images are stored in the United States as described in Section 4. Other processing locations depend on the service involved. Applicable safeguards and privacy obligations continue to apply to international processing. 11. Children and age limits Mercle is not intended for children under 13 or below a higher minimum age required by applicable law. The photo contribution campaign is restricted to people aged 18 or older. If you believe a child has provided information contrary to these requirements, contact us so we can investigate and take appropriate action. 12. Policy changes We update this policy when our practices change and revise the date above. We provide additional notice when appropriate. If a change requires new consent, we obtain it before the relevant new collection or use; continued app use alone does not replace required consent or expand the scope applying to earlier photo contributions. 13. We do not use personal information for advertising that tracks you across other companies’ apps or websites.\n\n4. Optional photo contribution campaigns\n\nParticipation and consent\n\nPhoto contributions are optional. Before enrollment, the app explains the proposed collection, purposes, processing services, storage location, retention and reward terms. You must explicitly agree, confirm you are at least 18 and contribute only photographs of yourself. Camera permission alone is not agreement to join this campaign.\n\nAccepted consent is remembered for the relevant campaign scope. A materially different processing scope requires a new description and explicit consent before that use. A later policy update, a reward or participation in identity verification does not automatically expand the consent applying to earlier contributions.\n\nCollection and purpose\n\nThe campaign uses contributed face photographs to develop and evaluate Mercle models for distinguishing different people and recognising a returning participant. Contributing photographs or receiving a reward does not verify your identity.\n\nWe retain the original HEIC/HEIF or JPEG camera file and prepare a separate full-resolution, upright JPEG for review and dataset preparation. Original files preserve their camera information; embedded metadata is removed from the prepared JPEG. We record limited information separately, including capture time, device and operating system, image dimensions, exposure and ISO, file checksums, preprocessing versions and quality annotations. We do not request location for this campaign.\n\nProcessing and access\n\nOn-device checks assist with framing and possible image-quality concerns. Amazon Web Services S3 stores campaign images privately in US East (N. Virginia), United States. AWS Rekognition DetectFaces processes submitted JPEGs for advisory face geometry, landmarks, pose, sharpness, brightness and occlusion information. Authorised Mercle reviewers inspect submissions. Provisional quality checks are not proof of identity or a guarantee of photograph quality.\n\nThis collection pipeline does not currently retain face embeddings or use a face-search collection. A future use that adds retained embeddings requires a separately described scope and renewed consent before that use. The separate identity verification service described in Section 5 can use face embeddings and face-search matching.\n\nRetention, stopping and deletion\n\nCampaign originals and prepared JPEGs are retained for up to 90 days. Temporary uploads expire after one day. Unfinished encrypted drafts on your device expire after 24 hours. Rejected or fraud-flagged contributions are excluded from identity-model training; retaining material in restricted quarantine does not authorise another use.\n\nYou can stop contributing or request deletion in My photo contributions. Stopping blocks future campaign collection and authorised use. Deletion requests target live photo copies within seven days and backup or processor copies within 30 days. Completion depends on operational verification; the app can show a deletion receipt and distinguish outstanding backup verification. Account deletion also initiates withdrawal and deletion of campaign contributions.\n\nEssential consent, reward and deletion records are maintained separately from the photographs. Deleting a photograph or withdrawing cannot automatically remove its influence from a model that has already been trained. A retained record or an earned reward does not authorise future training use of withdrawn contributions.\n\n5. Separate identity verification and liveness\n\nVerification uses camera captures and related results to establish that a live person is present, compare with an earlier identity, detect duplicates, prevent fraud and support account recovery or repeat verification. AWS Rekognition can perform liveness and face matching, and AWS S3 can store reference images. Mercle’s identity systems also process associated matching and security records.\n\nInformation may be used for internal testing, quality improvement and model development only within the purposes, notice and permissions applying to that collection. The optional campaign’s agreement is separate from verification.\n\nVerification reference images, face-matching representations and associated identity records are retained for ongoing matching, identity continuity and duplicate-registration or abuse prevention. Their retention depends on those purposes rather than the campaign's 90-day photo limit. Some of these records are preserved after deletion of an app account. Deleting your app account therefore does not automatically erase all verification face information.\n\nYou can request deletion of verification face information by contacting us. We review requests under applicable law and explain any information that must be retained, the reason and the applicable retention criteria. Continued retention for security or another purpose must have a valid basis; this policy does not authorise unrestricted reuse. Campaign photo deletion and its stated timeframes remain separate from this verification process.\n\n6. Service providers and other recipients\n\nWe use providers to operate the service. Depending on the feature, these include:\n\n- Amazon Web Services for hosting, storage, liveness, face matching, photo-quality analysis and messaging infrastructure.\n- Google Firebase for crash reporting and supported notification services.\n- Microsoft Clarity for interaction analytics and session replay, with masking and pausing in the photo contribution flow.\n- Email, SMS and WhatsApp delivery providers, including Resend and Twilio, for authentication and service communications.\n- Privy for supported embedded-wallet and wallet-authentication functionality.\n- Apple, Google, connected-account providers, wallet services and blockchain infrastructure when you use their integrations.\n\nProviders receive information needed for their role, such as contact details for message delivery, technical data for diagnostics or images for the face-processing operations described above. We require providers acting on our behalf to protect the information they receive through appropriate confidentiality, security and purpose restrictions consistent with this policy and applicable law. Providers you choose to use independently, including wallet apps, sign-in services and public blockchain networks, also operate under their own privacy terms.\n\nAuthorised Mercle personnel may access information for review, support, security and operations. A connected application can receive verification results, account or service identifiers and information covered by the permissions you approve for that integration.\n\nWe may disclose information when legally required or necessary to address a security incident, enforce our terms or protect users’ rights and safety. Information may also be transferred during a merger, acquisition or other business transfer, subject to applicable privacy obligations.\n\n7. Wallets and public blockchains\n\nConnecting a wallet lets Mercle process its public address, network and signatures or transaction requests that you authorise. Supported embedded wallets use a wallet provider to manage wallet functionality and cryptographic operations. Do not provide a seed phrase or private key to Mercle support.\n\nPublic addresses and blockchain transactions can be visible to anyone and may be permanent. Deleting a Mercle account or disconnecting a wallet cannot erase public blockchain history. Manage wallet permissions and transaction approvals through the relevant wallet or provider.\n\n8. Retention of other information\n\nAccount, profile, connected-service and wallet records are kept to operate your account and the features you use. When you request account deletion, the deletion process removes account records and initiates applicable linked-data cleanup. Any remaining record must be limited to an applicable legal, security, fraud-prevention, accounting or dispute purpose. The verification face-data exception is expressly described in Section 5; campaign photos follow Section 4.\n\nSupport correspondence, technical logs and security or consent records are retained according to the need to resolve requests, operate the service, investigate incidents, document permissions and meet applicable obligations. Their retention depends on the record’s purpose and any applicable legal requirement. We do not promise a single fixed period for every record category.\n\nBackup and provider copies can require additional time to be removed. Public blockchain records are controlled by the relevant network. Information that has been irreversibly anonymised and can no longer reasonably identify a person may be retained for aggregate analysis; a face photograph, face embedding or hashed identifier is not treated as anonymous merely because a name was removed.\n\n9. Your choices and requests\n\nYou can:\n\n- Decline optional photo contributions, stop participation or request campaign-photo deletion in My photo contributions.\n- Revoke camera and notification permissions in your device settings. Revoking camera permission stops future access; it does not delete previously submitted information.\n- Request deletion of your Mercle account through the in-app account settings or by emailing us with the subject “Delete my Mercle account”.\n- Request access, correction, deletion or other available rights by contacting us. For verification face information, identify that you want deletion of verification face data as well as any account deletion.\n- Disconnect supported wallets or linked services through the available account or provider controls.\n\nWe may request information needed to verify ownership before acting. Applicable law determines your rights, any permitted exceptions and response requirements. We explain when a request cannot be completed in full. Availability restrictions do not waive those rights. You may also contact the relevant privacy authority where that right applies.\n\n10. Security and international processing\n\nWe use safeguards such as encrypted network connections, encrypted local photo drafts, restricted storage, access controls and limited permissions to protect personal information. Access to sensitive face information is restricted to the personnel and systems needed for the described processing. No system is completely immune from security incidents. Where required, we notify affected users and authorities about a breach.\n\nMercle and its providers may process information in countries outside your own. Campaign images are stored in the United States as described in Section 4. Other processing locations depend on the service involved. Applicable safeguards and privacy obligations continue to apply to international processing.\n\n11. Children and age limits\n\nMercle is not intended for children under 13 or below a higher minimum age required by applicable law. The photo contribution campaign is restricted to people aged 18 or older. If you believe a child has provided information contrary to these requirements, contact us so we can investigate and take appropriate action.\n\n12. Policy changes\n\nWe update this policy when our practices change and revise the date above. We provide additional notice when appropriate. If a change requires new consent, we obtain it before the relevant new collection or use; continued app use alone does not replace required consent or expand the scope applying to earlier photo contributions.\n\n13. About this policy\n\nApex Labs Pte. Ltd. (“Mercle”, “we”, “us” or “our”) operates the Mercle mobile app, website, APIs, identity verification, rewards and wallet-related services. This policy explains what personal information we collect, why we use it, who receives it, how we retain it and how you can exercise your choices.\n\nFace photographs, facial representations and related verification information can be sensitive personal or biometric information. The optional photo contribution campaign has its own consent, purposes and retention limits, explained below. Its 90-day photo retention limit does not apply to separate identity verification records.\n\nMercle is not currently offered to residents of Africa or Europe, including the European Union, European Economic Area, United Kingdom and Switzerland. These availability restrictions do not remove any privacy rights that apply under law.\n\n2. Information we collect\n\nAccount and contact information\n\nWe collect information you provide to create, authenticate, recover or manage an account, such as an email address, phone number, country code, account identifiers, profile information and an optional profile picture. If you use Apple, Google or another supported sign-in provider, we receive the identifiers and profile information that the provider makes available for your chosen sign-in. We also process verification codes, authentication results and support messages.\n\nVerification and face information\n\nWhen you start camera-based verification, liveness, account recovery or a repeat verification, the relevant flow can collect face images or video frames, liveness results, facial representations used for matching, comparison results, verification status, timestamps and security records. A face embedding is a numerical representation used to compare faces. Verification can involve comparing a face with an earlier reference or searching for a possible duplicate identity.\n\nOptional photo contributions\n\nIf you separately agree to join a photo contribution campaign, we collect the front and side photographs you choose to submit, the original camera files, prepared review images, limited capture metadata and quality annotations. Section 4 describes these contributions in detail.\n\nWallets, connected services and rewards\n\nWe process public wallet addresses, blockchain networks, wallet-ownership verification signatures, transaction information, account-linked reward records and information needed to display balances or assets and carry out features you request. If you connect a supported social account or other service, we receive the account identifiers, verification results and information covered by the permissions you approve.\n\nDevice, interaction and technical information\n\nWe process device and operating system information, app version, language or locale, network information such as IP addresses, device or installation identifiers, notification delivery tokens, app interactions, crash reports and performance or security logs. Session replay and interaction analytics can help us understand navigation and diagnose usability problems. We mask photo contribution screens and pause replay during that flow.\n\nYour device also stores information needed to operate the app, including authentication tokens, preferences and session information. Unsubmitted photo contribution drafts are encrypted on the device and expire after 24 hours.\n\nWe do not purchase personal information from data brokers to build user profiles. The photo contribution flow does not request gallery access, GPS location, audio, video, depth captures or ProRAW. Permissions required by other app features are described when those features request them.\n\n3. How we use information\n\nWe use information to:\n\n- Create and authenticate accounts; verify contact details; support account recovery and user requests.\n- Check liveness and identity continuity, detect duplicate identities and reduce bots, spoofing, fraud and account abuse.\n- Provide rewards, connected-account features, wallet functionality and transactions you request.\n- Operate, secure and improve the app and its infrastructure, investigate errors and understand how features are used.\n- Send verification codes, service messages and notifications, subject to your applicable settings.\n- Develop, test and evaluate models and quality checks where that use is covered by the notice and consent applying to the data. Optional campaign contributions are governed by Section 4.\n- Maintain necessary consent, security, reward, dispute and compliance records and meet applicable legal obligations.\n\nWe do not sell personal information, supply face information to data brokers or use face or wallet information for third-party advertising.
